Terms & Conditions

1. Who you are contracting with

These Terms govern your use of InstaKitchen ("the Service"), operated by Instakitchen ("we", "us", "our"). By creating an account, accessing, or using the Service you agree to these Terms. If you are using the Service on behalf of an organisation, you confirm you have authority to bind that organisation. If you are using it as an individual, you confirm you are of legal age to enter into a contract in your jurisdiction.

2. The Service

InstaKitchen provides AI-assisted pantry management, recipe generation, meal planning, grocery list building, price comparison across supported vendors, and an optional wallet for use inside the app. Features and availability may change over time.

3. Accounts and accuracy

You are responsible for keeping your account credentials confidential and for all activity under your account. You must provide accurate information and keep it up to date.

4. Acceptable use

You agree not to misuse the Service. In particular, you must not:

  • Use the Service for unlawful, fraudulent, abusive, or spam purposes;
  • Infringe the intellectual property or other rights of anyone;
  • Interfere with security, probe, scan, scrape, or attempt to disrupt the Service;
  • Introduce malware, viruses or harmful code;
  • Attempt to reverse engineer, resell or redistribute the Service, or circumvent technical limits.

5. AI-generated content

InstaKitchen uses AI to suggest recipes, cooking tips, and other content. AI outputs may be inaccurate or incomplete and are not a substitute for professional dietary, medical, or safety advice. You are responsible for how you use outputs, for verifying accuracy (especially around allergies, dietary needs, and food safety), and for having the necessary rights to any content you submit as input (photos, receipts, prompts). We may refuse or filter outputs and remove content that violates these Terms. Prohibited uses include generating illegal content, harassment, hate speech, malware, or attempts to jailbreak the AI.

6. Intellectual property

We retain all rights, title and interest in the Service, including software, documentation and branding. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service within your chosen plan. Your content remains yours; you grant us a limited licence to host and process it solely to provide the Service to you.

7. Payments and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service enquiries and handles returns. Payment, billing frequency, taxes, cancellations and refund mechanics are further described in the Paddle Buyer Terms and our Refund Policy. Subscriptions renew automatically until cancelled.

8. Service level

The Service is provided on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, timely, error-free, or that AI outputs will meet your expectations. To the fullest extent permitted by law, we disclaim all implied warranties including merchantability and fitness for a particular purpose.

9. Liability

To the fullest extent permitted by law, our aggregate liability for any claim arising out of or relating to the Service is limited to the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by our negligence where that exclusion is not permitted by law.

10. Suspension and termination

We may suspend or terminate your access if you materially breach these Terms, fail to pay amounts due, pose a security or fraud risk, or repeatedly or seriously violate our policies. On termination your right to use the Service ends; we may delete your data after a reasonable period.

11. Changes to these Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of India. Disputes will be subject to the exclusive jurisdiction of the courts of India, unless mandatory local law provides otherwise.
